Terms of Service

These Terms of Service ("Terms") govern your access to and use of Aria Mail ("Aria Mail", "we", "us", or "our"), including the website at ariamail.app, the Aria Mail application, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 13 years old (16 in the EEA/UK) to use the Service. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately at security@ariamail.app if you suspect unauthorized access.
2. The Service
Aria Mail is an AI-native email client that lets you connect third-party mail accounts (such as Gmail, Outlook, and IMAP/SMTP mailboxes) and use a unified interface, search, and an AI assistant to work with your mail. Aria Mail is not an email host or provider; the actual messages remain with your upstream mail provider.
3. Your content and data
You retain all rights in the email content and other data you connect to the Service ("Your Content"). You grant Aria Mail a limited, worldwide license to access, process, transmit, display, index, and cache Your Content solely as necessary to provide the Service to you. This license ends when you disconnect an account or delete your Aria Mail account.
We do not sell Your Content, do not use it for advertising, and do not train machine learning or AI models on it. See the Privacy Policy for details.
4. Acceptable use
You agree not to:
- Use the Service to send spam, phishing, malware, or any other unlawful content.
- Attempt to access accounts or data that do not belong to you.
- Reverse-engineer, decompile, or circumvent security controls of the Service, except where permitted by law.
- Interfere with the Service, its infrastructure, or other users' use of it.
- Use the Service to violate any applicable law, regulation, or third-party right, or the terms of your upstream mail provider.
- Resell, sublicense, or provide the Service as a managed offering without our written permission.
5. Third-party services
The Service depends on third-party providers, including Google (Gmail, Google OAuth), Microsoft (Microsoft 365, Microsoft Graph), IMAP/SMTP providers you designate, Stripe (payments), and Anthropic (AI inference). Your use of those third-party services is governed by their own terms and privacy policies. We are not responsible for outages, errors, or policy changes caused by those providers.
6. Subscriptions, billing, and refunds
Paid plans are billed in advance on a recurring basis (monthly or annually, as selected) through Stripe. You authorize us (via Stripe) to charge your chosen payment method at each renewal until you cancel. Fees are non-refundable except where required by law, or as expressly stated on the pricing page.
You can cancel at any time from Settings. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then.
We may change prices with at least 30 days' notice. New prices will apply at your next renewal.
7. Free plan and quotas
The Service may offer a free plan with usage quotas (for example, a maximum number of AI requests or connected accounts). Quotas may change over time. We may suspend or throttle access if usage indicates abuse.
8. Beta features
We may offer beta or experimental features. Beta features are provided "as is", may change or be withdrawn at any time, and may have lower availability or higher error rates than the general Service. You use beta features at your own risk.
9. Intellectual property
The Service, including its software, design, and content other than Your Content, is owned by Aria Mail or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms. All rights not expressly granted are reserved.
10. Feedback
If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.
11. AI output
The Service uses large language models to generate answers, summaries, and drafts. AI output may be inaccurate, incomplete, or inappropriate for your situation. You are responsible for reviewing and verifying AI output before relying on it or sending it to others. Do not use the Service for decisions that require professional, legal, medical, or financial advice.
12. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms, if your use creates risk or liability for us or other users, or if we are required to do so by law. You may terminate at any time by deleting your account from Settings. Upon termination, your license to the Service ends and we will delete Your Content in accordance with the Privacy Policy.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARIA MAIL AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, OR DATA, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE GREATER OF USD $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
15. Indemnification
You will defend, indemnify, and hold harmless Aria Mail from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from (a) Your Content, (b) your use of the Service in violation of these Terms, or (c) your violation of any law or third-party right.
16. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Delaware, unless your local law requires otherwise.
17. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
